We are committed to providing clean, clear information that enables our customers to understand all aspects of our terms and conditions and communicate effectivly with us.

Definitions:
Perishable Goods: All food, flowers, drink and other goods that will naturally derteriate or go off.
Non-Perishable Good: All goods which do not fall under the above category.

Delivery
1. All delivery services are contracted to and conducted by APC Overnight (www.apc-overnight.com). Deliveries are made in accordance with their terms and conditions.

2. We can only guarantee delivery within the timescales specified on the delivery options, if your order is placed before 3pm on the day before the day of delivery required.

Complaints procedure
a. In the event that your not happy with your purchase, are unhappy about our service or any other aspect of our business we want to know about it. Please email us initialy to complaints@theblacksmithsdaughter.com.

Warranty
All non-perishable goods are covered by a 1 year warranty, subject to them being looked after and cared for according the manufactuers or our instructions and/or guides.

Orders


1. All Our products as depicted on this website are available for delivery anywhere in the UK and N.Ireland.

2. All prices include delivery; please allow 1-2 days for delivery. We may send out flowers two days prior to the requested date to ensure flowers arrive on the intended date, they may arrive a day earlier.

3. In accordance with the long Distance Selling Directive (2000) you may cancel your order at any time without reason, within 3 working days of delivery. Orders for flowers and other perishable goods may not be cancelled should you wish to cancel your order and receive a refund; you must confirm this writing within 3 days of receipt and return the packaged item to us at the above address. We regret that you may not cancel an order for perishable products. (see T&C No8)

4. Bouquets may be delivered by us in bud to ensure longer life.

5. All products are subject to availability; in the event of any supply difficulty we reserve the right to substitute any Our product of equal value and quality without notice.

6. In the event that we are unable to supply any Our products or any substitute to you at all, we shall notify you as soon as possible and shall reimburse your payment in full no later than 30 days after the intended date of delivery.

7. In the event of dissatisfaction a replacement will be delivered if we are notified of your complaint within 3 days of delivery for perishable items and 7 days for all other items.

8. Should a refund be required we will require the products to be returned to us unused and in as new condition, you will be liable for all postage costs incurred as a result of returning items to us, we cannot issue a refund until we have received the goods, we advise that you obtain proof of posting when you return goods to us, upon receipt a full refund will be made.

9. Our products will be delivered by Royal Mail or by our own drivers; orders received by 4.30pm Monday to Friday will be delivered next day or your intended date of delivery. Orders received after 4.30pm Friday may not be delivered until Tuesday.

10. To avoid problems or delays with delivery, please ensure that you have included the full address details, including accurate postcode of the intended recipient, we will not be held responsible for items that are not delivered due to incorrect address details.

11. In the event that you are not satisfied with the Our Service any complaints should be addressed in the first instance to: support@theblacksmithsdaughter.co.uk or in writing to the above address

By clicking on the 'check out' button at the end of the order process, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the Our site. Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.

13. We exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Our Site and/or the Our Service, whether arising in contract, tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the products supplied. We shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.

14. We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Our Site and/or the Our Service from time to time. We will post any changes on the Our Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Our Service or Our Site. Changes will be effective 24 (24) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.

15. Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

16. All other rights, including copyright, in this website are owned by Bloomin' Delightful. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use is prohibited without the permission of Our. You may not modify, distribute or repost something on this website for any purpose.
